General Terms of Use of the GeekHunter Platform

These Terms of Use of the Platform of GeekHunter Seleção e Agenciamento de Mão-de-obra LTDA (“GeekHunter”) establish the terms and conditions for the use of the Platform by Users, understood as candidates (“Potential Employees”) and companies (“Client”), under free or paid plans. The use of the Platform implies reading and agreeing to these Terms of Use and the Privacy Policy, which is an integral part hereof.

Any User who wishes to use the services offered by the GeekHunter Platform must first read and accept the conditions established in these TERMS OF USE and the PRIVACY POLICY, which is incorporated herein.

Any User who does not accept the conditions presented in the TERMS OF USE or the PRIVACY POLICY must refrain from using the services offered by GeekHunter.

The Platform must be used lawfully and solely for the purposes set forth in these TERMS OF USE.

1. DEFINITIONS

Platform: Online environment of GeekHunter, accessible through the website or other digital channels, that connects companies and professionals for recruitment, selection, and hiring purposes.
Services: Set of functionalities provided by the Platform, including search and promotion of profiles, automated screening and matching, AI-assisted interviews, profile data enrichment from external sources (such as LinkedIn and other public websites), management of recruitment processes, and support for professional hiring.
User: Any natural or legal person who accesses or uses the Platform, whether as a Professional (job candidate) or as a Company (client or recruiter).
Professional / Candidate / Potential Employee: Natural person who creates a profile on the Platform to apply for job vacancies, participate in selection processes, or be promoted in the Talent Pool. For the purposes of these Terms, these terms are equivalent.
Company / Client: Legal entity, or its authorized representatives, that uses the Platform to search for, evaluate, interview, and hire professionals.
Talent Pool: Database composed of profiles of Professionals registered or enriched by the Platform, accessible by GeekHunter and, in certain cases, by client companies, according to the purposes set forth in these Terms and the Privacy Policy.
Personal Data: Information related to an identified or identifiable natural person, collected directly by GeekHunter, provided by Users, or automatically obtained by the Platform, as defined in the Privacy Policy and applicable law.
Content: Any information, data, material, or document made available, generated, or shared on the Platform by Users or by GeekHunter, including texts, images, videos, transcripts, annotations, and automatic inferences.
AI (Artificial Intelligence): Automated resources applied by GeekHunter to support interviews, enrich profiles, generate recommendations, perform matching, detect fraud, and optimize Services.
Parties: GeekHunter, Client, and Professional.

2. AMENDMENTS

GeekHunter may occasionally update these Terms for legitimate reasons. In the case of significant changes, the company undertakes to inform you and request your acceptance of the revised version. We recommend consulting this page regularly to stay informed about the most recentPlatform.

3. SERVICES OFFERED BY GEEKHUNTER

Talent Pool: Availability of a pool of professionals (“Potential Employees”) so that companies (“Clients”) can identify, invite, and select candidates for job opportunities.
ATS – Applicant Tracking System: Availability of a technological tool designed for managing and automating recruitment processes, allowing the Client to organize recruitment workflows from the opening of a vacancy to hiring, with the ability to input and manage candidate data, use external integrations, and post opportunities.
Tech Recruiter as a Service (TRaaS): Availability of professionals specialized in recruitment to support the Client in attracting, screening, and pre-selecting candidates, acting on behalf of and for the Client in the recruitment process.

GeekHunter may also provide additional functionalities or new service modalities, which will be previously communicated and shall become part of these Terms of Use.
Each of these modalities will observe specific rules regarding the rights and responsibilities of GeekHunter, the Client, and the Potential Employee, as provided herein.

4. RIGHTS AND OBLIGATIONS OF THE CLIENT

The Client wishing to hire GeekHunter's services must register through the form available on the website https://www.geekhunter.com.br to access the Platform and is aware that the information provided is their responsibility, being civilly and criminally liable for any violation of third-party rights or incorrect information provided. Furthermore, the Client must:

Be of legal age and capable of performing civil acts or be represented by a legal representative with management powers of the Client company.
Ensure the truthfulness and updating of the information provided when contracting GeekHunter’s services for Platform access.
Be aware that they are responsible for all activities occurring under their account on the Platform.
Agree to keep confidential all information obtained from the use of the Platform and GeekHunter’s services.
Ensure not to use any content, information, or personal data submitted by Professionals for purposes not in accordance with GeekHunter’s privacy policy or data protection laws.
Refrain from disclosing the name or identity of any Professional listed on the Platform outside of their recruitment or hiring department, ensuring that their employees, agents, directors, partners, etc., act accordingly.
Ensure the implementation of adequate physical, technical, and administrative measures to protect content obtained through the use of the Platform and GeekHunter’s service against loss, misuse, unauthorized access, disclosure, alteration, or destruction, in accordance with applicable law.
Notify GeekHunter in the event of unauthorized use or suspected unauthorized use of their account or services offered by GeekHunter.
The Client is solely responsible for the use of their account, its security, and safeguarding access passwords to the Platform. GeekHunter is not liable for any misuse, loss, or damage resulting from failure to comply with these obligations.
In case of the Client’s account deactivation due to any breach, GeekHunter may cancel the provision of services, reserving the right to charge for any service already completed.
The Client agrees not to sell, transfer, or assign their right to use the service to any third party, nor offer the service or any content obtained from the Platform for commercial purposes without GeekHunter’s express consent.
In the event of practices contrary to these TERMS OF USE, GeekHunter may prohibit the creation of new users directly or indirectly linked to deactivated accounts.
The Client may browse, invite to interviews, and contact Potential Employees listed on the Platform and through GeekHunter’s services upon payment of the applicable service fee, according to their needs.
By registering their company on the Platform, the Client authorizes GeekHunter to use its name, brand, and/or logo—with preservation of all property rights—in presentations, marketing materials, client lists, financial reports, websites, result pages, and references. Exceptions apply to Clients with an express non-inclusion clause in the adhesion term/plan signed with GeekHunter.
This Agreement does not create any employment, corporate, associative, agency, consortium, joint venture, or similar relationship between the Client and GeekHunter, each being responsible for their respective obligations under current law.

5. RIGHTS AND OBLIGATIONS OF THE POTENTIAL EMPLOYEE

The Potential Employee must be over 18 years old and legally capable, or properly represented/assisted if incapacitated, to apply for vacancies offered on the Platform.
The Potential Employee wishing to use the Platform and GeekHunter’s services must complete the online registration form truthfully, clearly, and completely, to provide the necessary information for the Client to assess the Potential Employee’s technical characteristics for suitability for the offered vacancy.
The Potential Employee is solely responsible for the accuracy of the information provided and may be civilly and criminally liable for any false information, acknowledging that such data will be viewed by GeekHunter and may be viewed by Clients with Platform access.
The Potential Employee explicitly consents to the presentation of personal data requested during registration for the purposes set forth in these TERMS OF USE and the PRIVACY POLICY, declaring that they have read and agree to its terms.
The completion of the registration for the use of the Platform and GeekHunter’s services does not provide the Potential Employee with any guarantee of employment by any Client who has access to the Platform, as the purpose of the service provided is limited solely to facilitating the connection between the Potential Employee and the Client. There is no obligation on the part of the Potential Employee to accept any offer from any Client, and such acceptance should occur only when there is a legitimate interest in the position offered. Likewise, the Client is not obliged to hire the Potential Employee or to maintain any employment relationship for a specific period, except where otherwise agreed between the Potential Employee and the Client through a separate agreement. In such a case, there shall be no link or responsibility on the part of GeekHunter with respect to its terms. The Potential Employee is not required to accept the best interview invitation or any other invitation. Moreover, the proposals presented by a Client to a Potential Employee through the bidding or selection process are not binding upon the employer. At the end of the bidding or selection process, the Potential Employee may choose which Client, if any, they wish to interview with.
On GeekHunter, duplicate or fictitious profiles, or any data that may mislead other users, are not permitted. The Potential Employee must ensure that all information provided in their profile is true and accurate, including details about themselves, their company (if applicable), qualifications, professional experience, affiliations, or achievements. They must use only their own image as a profile photo and refrain from representing another person or using images that do not belong to them. The Potential Employee must not link their profile on the Platform to companies, businesses, or organizations with which they do not have a legitimate professional relationship. Furthermore, they must not attempt to access or use another person’s account on GeekHunter, nor create a profile on behalf of a third party. Each account is individual and must not be shared with other people. In the event of misuse or unauthorized access to their account, the Potential Employee must immediately notify GeekHunter’s support team, assuming the risks resulting from any irregular access until the issue is resolved.
The detection of any false information provided by the Potential Employee, or any conduct that is inconsistent with GeekHunter’s Policies and Foundational Principles of Conduct, may result in the immediate deletion of their registration on the Platform and the prohibition of new registrations by the Potential Employee, at GeekHunter’s sole discretion.
By applying for a job vacancy, the professional becomes part of both the GeekHunter Talent Pool and the recruiting company’s own talent database, which allows for the retention of their data even after the completion of the selection process. The professional may, at any time, choose to restrict the visibility of their profile exclusively to the selection process for which they applied or request the deletion of their data from GeekHunter.

6. RIGHTS AND OBLIGATIONS OF GEEKHUNTER

GeekHunter provides Clients with selection results and software tools enabling them to find and connect with Potential Employees.
The use of the Platform does not create any hiring obligation between Potential Employees and Clients.
Client access is subject to a formal agreement or adhesion term with GeekHunter and compliance therewith.
Any agreements created between the Client and the Potential Employee are not binding upon GeekHunter. GeekHunter is neither responsible for nor obligated to comply with any agreements made between the Client and the Potential Employee. The Client shall not consider GeekHunter, nor shall GeekHunter be interpreted, as a party to such agreements or similar arrangements, regardless of whether GeekHunter receives compensation for the provision of its services or grants access to the Platform.
GeekHunter shall not be held liable for: (i) technical failures or temporary unavailability of the Platform resulting from factors beyond its reasonable control, such as internet instability, failures of third-party servers, or force majeure events; (ii) misuse by third parties, provided that reasonable security measures have been implemented; and (iii) hiring or management decisions regarding Professionals made solely by the Client.
GeekHunter shall use its best efforts to maintain the continuous availability and regular operation of the Platform, implementing appropriate technical and administrative safeguards to ensure reasonable levels of performance, reliability, and security. In the event of Platform downtime or severe failures that materially affect access to or use of the services, GeekHunter will adhere to the following Service Level Agreements (SLAs) for response and resolution: Critical Incidents (total unavailability or severe access disruption): initial response within twelve (12) business hours, and estimated resolution within twenty-four (24) business hours from the time the incident is reported through the following support channel: https://suporte.geekhunter.com.br/support/tickets/new. GeekHunter shall not be liable for interruptions caused by force majeure, acts of God, failures of third-party internet service providers, or other events beyond its reasonable control, provided that affected Users are notified in an appropriate and timely manner.
GeekHunter shall notify Users affected by any security incident involving the leakage, loss, destruction, or unauthorized access of personal data within a reasonable time after confirming the incident, and preferably within seventy-two (72) business hours, in accordance with Law No. 13.709/2018 (Brazilian General Data Protection Law – LGPD). Such notice shall include, to the extent known at the time, relevant information regarding the nature of the incident, the corrective or mitigating measures adopted, and any recommendations applicable to the affected Users.

7. SERVICES, PURPOSE, AND USE OF THE PLATFORM

GeekHunter offers functionalities designed to optimize the recruitment processes of Client Companies, encompassing both modalities of access to a talent database to find candidates who meet the characteristics and requirements of open positions, and a management and automation system for selection processes. GeekHunter also provides a specialized recruitment service to assist in the acquisition and selection of professionals according to the specific needs of companies that contract such service separately.
Data Sharing: The data provided by Potential Employees are stored in a secure environment and shared in accordance with the principles of necessity, minimization, and specific purpose, as set forth in the Privacy Policy, including with Client Companies and essential service providers for operation (for example, cloud, communication, and analytics providers), as well as HR or people management consultancies hired by the Companies. Details regarding purposes, legal bases, retention periods, data subject rights, and security measures are included in GeekHunter’s PRIVACY POLICY.
Connection with Other Job Openings: The company responsible for a selection process may invite the Potential Employee to participate in other opportunities compatible with their profile, even if related to positions different from those initially applied for, with the aim of facilitating their hiring.
GeekHunter Talent Database: By creating a profile on the Platform, the Potential Employee becomes part of GeekHunter’s Talent Database. When the profile is marked as visible, it may be accessed by Companies with access to the Platform, even if there is no active selection process. The user may make their profile invisible at any time or request the deletion of their data, in accordance with GeekHunter’s PRIVACY POLICY. For more details on the personal data processed by GeekHunter, their respective purposes, and the legal basis for such processing, please refer to GeekHunter’s PRIVACY POLICY.
GeekHunter is responsible for ensuring the possibility of creating new users for the purpose of using the same Client account on the GeekHunter Platform, provided that such users have a direct relationship with the Client, possess a corporate email address belonging to the Client, and are included in a plan that allows for additional users.

8. WARRANTY TO THE CLIENT

8.1 NON-EXCLUSIVITY: The PARTIES shall have no obligation to maintain exclusivity in the relationship between GEEKHUNTER/CLIENT/POTENTIAL EMPLOYEE, being permitted to register, hire, or provide similar services. The registration or hiring shall not create any exclusive bond between the PARTIES.

9. CONFIDENTIALITY

9.1 The PARTIES shall maintain absolute confidentiality regarding the data, materials, information, documents, commercial specifications, and other proprietary information of the other PARTY to which they may have access (“Confidential Information”). The PARTIES shall not publish, disclose, make available, or use the Confidential Information without prior written authorization, under penalty of just cause for termination of this Agreement and direct liability for any losses and damages suffered by the affected PARTY resulting from non-compliance with this Clause.

9.2 The confidentiality obligations contained in this clause shall not apply to any information or material that the PARTIES can demonstrate: (i) was already in their possession prior to disclosure by the other PARTY; (ii) is or becomes public domain without fault, omission, or any act of either PARTY; or (iii) is lawfully obtained from third parties without any confidentiality obligation by the PARTIES.

10. INTELLECTUAL PROPERTY RIGHTS

10.1 The Platform and the services provided by GeekHunter are its exclusive property. Registration or contracting shall not grant any authorization for use, sale, co-participation, or any other right concerning the trademark, source code, know-how, etc. Users are prohibited from copying, modifying, distributing, selling, or renting any part of the Platform, as well as from performing reverse engineering or attempting to extract its source code. Any infringement, damage, decompilation, or extraction of source code, or any attempt thereof, must be promptly reported to GeekHunter.

10.2 Intellectual property over AI-generated inferences and content. The inferences, recommendations, analyses, or profile enhancements generated by the Platform’s Artificial Intelligence features are owned by GeekHunter, which grants the Potential Employee and the Client a limited, non-exclusive, non-transferable license, restricted to the purposes of recruitment, selection, and hiring.

10.3 Authorizations. The Parties undertake to process personal data in accordance with Law No. 13,709/2018 (LGPD) and other applicable regulations, observing the purposes, legal bases, retention periods, and data subject rights described in the Privacy Policy. When consent is the applicable legal basis, it shall be obtained freely, informedly, and unequivocally. The Parties shall adopt appropriate technical and administrative measures to protect data against unauthorized access and security incidents.

The Client is prohibited from selling, sharing, or assigning data to third parties for any purpose; using any method intended to perform reverse engineering; identifying data subjects; transferring, deleting, adding, altering, or otherwise processing data and information; as well as using, sharing, or commercializing any data elements, products, or by-products originating from or created through data processing. It is also forbidden to use automated mechanisms, scraping, spiders, crawlers, bots, or similar tools for data collection or extraction from the Platform, without GeekHunter’s prior written request or authorization (Controller).

11. TERM AND DURATION

11.1 These TERMS OF USE shall remain in force for an indefinite period and shall govern all relationships between GeekHunter, the Client, and the Potential Employee.

11.2 The Potential Employee or GeekHunter may terminate the registration at any time. In the event of termination, GeekHunter shall delete or anonymize personal data to the extent possible, except in cases of retention provided by law or in the Privacy Policy (for example, compliance with legal/regulatory obligations, regular exercise of rights, fraud prevention, and security).

11.3 Without prejudice to the provisions of these Terms of Use and to liability for any damages that may arise, non-compliance with any applicable legal rule and/or any obligation set forth herein or deriving therefrom shall entitle the affected party to consider these Terms automatically terminated, for just cause, regardless of prior notice or compliance with any advance notice period.

GeekHunter further reserves the right to suspend, block, or terminate accounts, as well as to adopt any applicable legal measures, in the event of non-compliance with these Terms by the Users.

12. Ethical Conduct and Enforcement

12.1 GeekHunter, Client Companies, and Potential Employees agree to uphold the highest standards of ethics, integrity, respect, and non-discrimination throughout their use of the Platform and any related interactions. The following acts shall constitute material ethical violations, subject to immediate suspension or termination of the user’s account, without prejudice to any applicable civil or criminal liability:

using the Platform for any unlawful, fraudulent, or discriminatory purpose;
publishing or distributing offensive, defamatory, racist, misogynistic, homophobic, or otherwise harmful or rights-infringing content;
attempting to improperly access, obtain, or misuse confidential information or personal data belonging to third parties;
engaging in any conduct that violates the Privacy Policy, the Brazilian General Data Protection Law (LGPD), or these Terms of Use;
breaching any compliance, anti-corruption, or fair competition laws or regulations, including but not limited to Brazilian Law No. 12.846/2013 (Anti-Corruption Law).

12.2 GeekHunter reserves the right to conduct an internal investigation to determine whether an ethical breach has occurred. When applicable, the user shall be guaranteed the right to be heard and to present a defense. Upon confirmation of a violation, GeekHunter may, at its sole discretion and in proportion to the severity of the infraction, impose one or more of the following measures:
